3. Customer-Provided Designs and IP Warranty

For custom manufacturing projects, users may upload CAD files, technical drawings, or proprietary designs.

  • Ownership Warranty: The user guarantees that they own all Intellectual Property (IP) rights to the designs submitted or have obtained the necessary licenses.
  • Indemnification: Damao Tech shall not be held liable for any patent, copyright, or trademark infringement if we manufacture products according to the designs, specifications, or samples provided by the user.
  • Liability Waiver: The user agrees to indemnify and hold Damao Tech harmless against any legal claims or damages arising from IP disputes related to user-provided designs.

4. Product Information and Sales Governance

The technical specifications, material properties, and images provided on this website are for reference purposes only.

  • Sales Contracts: All actual sales, pricing, and shipping terms are strictly governed by formal Proforma Invoices (PI) or Sales Contracts issued directly by Damao Tech. In the event of a conflict between the website and a formal PI, the PI shall prevail.
  • Material Tolerances: As is standard in industrial manufacturing, all materials (including EVA foam) are subject to industry-standard tolerances regarding thickness, density, and color variance.

5. Limitation of Liability

Damao Tech shall not be liable for any indirect, incidental, or consequential damages (including loss of profits) arising from the use of our materials or website information. Our maximum liability for any transaction is limited to the value of the goods actually purchased under a formal Sales Contract.

6. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the People’s Republic of China (P.R. China). Any disputes arising from these terms or website usage shall be submitted to the exclusive jurisdiction of the courts where Damao Tech is registered.
